Notice of Passing of a Temporary Use By-Law (459 Government St)
TAKE NOTICE THAT that the Council of the Corporation of the City of Dryden passed By-law 2023-57 on November 27, 2023, to amend Zoning By-law 2740-2000. This amendment specifically pertains to the Storage Container By-law, amendment Number 2618-2019 as amended. This decision was made pursuant to Section 39 of the Planning Act, R.S.O. 1990, c.P.13, as amended. Under Section 34 of the Planning Act, the Council of a local Municipality may, through a By-law, authorize the temporary use of land, buildings, or structures for any purpose set out therein that is otherwise prohibited by the Zoning By-law.
By-law 2023-57 amends Zoning By-law 2740-2000 and applies to lands known municipally as 459 Government Street, legally described as Con 6 Pt Lot 3 Van Horne TWP DES 23R7024 Parts 4 5 & 6 Parcel 37254; City Of Dryden, District Of Kenora.
TAKE NOTICE THAT:
i.Only individuals, corporations and public bodies may appeal a by-law to the Local Planning Appeal Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.
ii.No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Local Planning Appeal Tribunal, there are reasonable grounds to add the person or public body as a party.
Any person or agency may appeal to the Local Planning Appeal Tribunal (https://elto.gov.on.ca/) in respect to the By-law by filing with the Clerk of the Corporation of the City of Dryden no later than December 17, 2023. A notice of appeal must set out the reasons for the appeal and must be accompanied by the prescribed fee of $300.00. Cheques are made payable to the Minister of Finance.
